Subscription: Subscription refers to the recurring access granted to users to use the Service, as detailed in the selected subscription plan.

Order: Order refers to the purchase of Goods or the act of subscribing to our Service.

Account refers to the personalized access granted to users upon registration, which contains their personal settings, preferences, and other data.

Feedback: Feedback includes, but is not limited to, comments, suggestions, opinions, or other input provided by users regarding the Service or any aspect of EdgHouse.

Affiliates: Affiliates refers to any parent company, subsidiary, branch, or any other entity under common control with EdgHouse.

Free Trial: Free Trial refers to the temporary access granted to new users to try the Service for free, as specified during the sign-up process.

Placing Orders for Goods

By placing an Order for Goods through the Service, You warrant that You are legally capable of entering into binding contracts.

Subscription and Services

By subscribing to EdgHouse’s services, you gain access to digital tools to help visualize and research sports betting data.

Your Information

Information Requirement for Order Placement: When placing an Order for Goods or accessing platform services on EdgHouse, you may be prompted to provide specific details relevant to your Order or service request. This can include, but is not limited to:

• Your name
• Email address
• Phone number
• Credit card or debit card details
• Billing and shipping address

Representation and Warranties: You hereby declare that:

• You possess the legal authority to employ any credit/debit card(s) or other payment mechanisms for your Order or service request.
• All data you provide to EdgHouse is accurate, genuine, and up-to-date.

Permission to Share Information: By offering the aforementioned details, you authorize EdgHouse to relay this information to third-party payment processors. This is to ensure the completion of your Order or service request on the platform.

Order Cancellation

EdgHouse’s Rights: We reserve the right to refuse or cancel your order at any time due to specific reasons, which may include but are not limited to:

• Unavailability of Goods.
• Errors in the description or pricing of Goods.
• Errors in your order submission.
• Suspicions of fraudulent activity or unauthorized/illicit transactions.

Your Order Cancellation Rights

Returns & Refunds: Any Goods you purchase can be returned only in accordance with these Terms and Conditions and our Returns Policy. Our Returns Policy is integral to these Terms and Conditions, so we encourage you to familiarize yourself with it to understand your rights regarding order cancellations.

Condition of Returned Goods: To be eligible for a refund, the Goods must be returned in the same condition you received them. This includes retaining all original instructions, documentation, and packaging. Goods damaged, not in their original state, or showing wear beyond simply opening the packaging will not qualify for a refund. Thus, it’s essential to maintain the Goods’ condition while they are in your possession.

Reimbursement: Once we receive the returned Goods, we will process your refund within 14 days. The refund will be made using the same payment method you used for your order, and you will not be charged any additional fees for this reimbursement.

Exclusions: Certain Goods are exempted from being returned, including but not limited to:

• Goods tailored to your specifications or those that are personalized.
• Goods which, by nature, are unsuitable for return, have a rapid rate of deterioration, or are past their expiry date.
• Goods that, for health protection or hygiene reasons, are not suitable for return after being unsealed post-delivery.
• Goods which, once delivered, become inseparably intermixed with other items.
• Digital content not provided on a tangible medium if its provision commenced with your prior express consent and you have acknowledged the consequent loss of your cancellation right.

Availability, Errors and Inaccuracies

We are constantly updating Our offerings of Goods on the Service. The Goods available on Our Service may be mispriced, described inaccurately, or unavailable, and We may experience delays in updating information regarding our Goods on the Service and in Our advertising on other websites.

We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Prices Policy

The Company reserves the right to revise its prices at any time prior to accepting an Order.

The prices quoted may be revised by the Company subsequent to accepting an Order in the event of any occurrence affecting delivery caused by government action, variation in customs duties, increased shipping charges, higher foreign exchange costs and any other matter beyond the control of the Company. In that event, You will have the right to cancel Your Order.

Payments

All Goods purchased are subject to a one-time payment. Payment can be made through various payment methods we have available, such as Visa, MasterCard, Affinity Card, American Express cards or online payment methods (PayPal, for example).

Payment cards (credit cards or debit cards) are subject to validation checks and authorization by Your card issuer. If we do not receive the required authorization, We will not be liable for any delay or non-delivery of Your Order.

Subscription Renewals

Automatic Renewal: Unless otherwise specified, all subscription plans to EdgHouse’s services are set to automatically renew at the end of the subscription period. This ensures an uninterrupted experience for our users. The renewal will be charged to the same payment method you used for the original subscription unless otherwise specified.

Notification: We will attempt to notify you before your subscription renews, giving you a window to review and make changes if needed. This notification will be sent to the email address associated with your account. It is your responsibility to keep your contact information updated and to check these notifications.

Changes to Subscription: If you wish to modify or cancel your subscription, you can do so through your account settings on EdgHouse. Any changes made will come into effect at the end of your current billing cycle. Please ensure you make modifications before the renewal date to avoid unwanted charges.

Price Changes: EdgHouse reserves the right to adjust subscription prices. Any price changes will be communicated to you at least 30 days in advance, allowing you ample time to adjust or cancel your subscription should you choose to. If you continue with your subscription past the notice period, it will be considered acceptance of the new rates.

No Refunds: Unless otherwise specified in our Refund Policy, subscription fees are non-refundable. If you cancel or modify your subscription, you will retain access to your subscribed services until the end of your current billing cycle.

Termination by EdgHouse: We reserve the right to terminate or suspend your subscription if there’s any breach of the platform’s terms, including but not limited to, failure of payment. In such cases, no refunds or credits will be provided for the unused portion of the subscription period.

This section aims to provide a clear framework for how subscription renewals work, what users can expect, and how they can manage their subscriptions. However, ensure this content aligns with your business practices and consult with legal counsel to ensure it is appropriate.

Subscription Period

The Service or some parts of the Service are available only with a paid Subscription. You will be billed in advance on a recurring and periodic basis (such as daily, weekly, monthly or annually), depending on the type of Subscription plan you select when purchasing the Subscription.

At the end of each period, Your Subscription will automatically renew under the exact same conditions unless You cancel it or the Company cancels it.

Subscription Cancellations

You may cancel Your Subscription renewal either through Your Account settings page or by contacting the Company. You will not receive a refund for the fees You already paid for Your current Subscription period and You will be able to access the Service until the end of Your current Subscription period.

Billing

You shall provide the Company with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information.

Should automatic billing fail to occur for any reason, the Company will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.

Fee Changes

The Company, in its sole discretion and at any time, may modify the Subscription fees. Any Subscription fee change will become effective at the end of the then-current Subscription period.

The Company will provide You with reasonable prior notice of any change in Subscription fees to give You an opportunity to terminate Your Subscription before such change becomes effective.

Your continued use of the Service after the Subscription fee change comes into effect constitutes Your agreement to pay the modified Subscription fee amount.

Refunds

Except when required by law, paid Subscription fees are non-refundable.

Certain refund requests for Subscriptions may be considered by the Company on a case-by-case basis and granted at the sole discretion of the Company.

Free Trial

The Company may, at its sole discretion, offer a Subscription with a Free Trial for a limited period of time.

You may be required to enter Your billing information in order to sign up for the Free Trial.

If You do enter Your billing information when signing up for a Free Trial, You will not be charged by the Company until the Free Trial has expired. On the last day of the Free Trial period, unless You cancelled Your Subscription, You will be automatically charged the applicable Subscription fees for the type of Subscription You have selected.

At any time and without notice, the Company reserves the right to (i) modify the terms and conditions of the Free Trial offer, or (ii) cancel such Free Trial offer.

Promotions

Promotions made available through the Service may be governed by rules separate from these Terms. If you participate in any promotions, please review the applicable rules and our Privacy policy. If the rules for a Promotion conflict with these Terms, the Promotion rules will apply.

User Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current. Failure to do so constitutes a breach of these Terms, which may result in immediate termination of your account. You are responsible for safeguarding your password and any activities under your password.

Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of the Company and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of the Company.

Your Feedback to Us

You assign all rights, title, and interest in any Feedback you provide the Company. If for any reason such assignment is ineffective, you agree to grant the Company a non-exclusive, perpetual, irrevocable, royalty-free, worldwide right and license to use, reproduce, disclose, sublicense, distribute, modify and exploit such Feedback without restriction.

Our Service may contain links to third-party websites or services that are not owned or controlled by the Company. The Company has no control over and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

Disclaimers and Limitations of Liability

General: All information, services, and Goods provided by EdgHouse are on an “as-is” and “as-available” basis, without any warranties or representations of any kind. This includes, without limitation, the completeness, accuracy, reliability, or fitness for a particular purpose of any Goods, services, or content provided.

No Endorsement for Betting: EdgHouse neither endorses nor encourages sports betting or gambling in any form. Any data, analytics, predictions, or information provided by EdgHouse should not be used for betting purposes. Using EdgHouse’s services for sports betting or any gambling activities is at the user’s own risk. EdgHouse will not be held responsible for any losses, damages, or consequences resulting from such activities.

Limitation of Liability: To the maximum extent permitted by applicable law, EdgHouse, its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; or (c) any other matter relating to the service.

User Responsibility: It remains the user’s responsibility to ensure that their use of EdgHouse complies with local laws and regulations, especially concerning activities like sports betting or gambling.

No Guarantee: While we strive to provide accurate and reliable information, we cannot guarantee the completeness or accuracy of any information provided on the platform. Users are advised to verify information from multiple sources before making any decisions.

Service Provided “AS IS” and “AS AVAILABLE”:

The Service is provided to you “AS IS” and “AS AVAILABLE” and with all faults and defects without warranty of any kind. User’s Responsibility:

Termination

We may terminate or suspend your Account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms and Conditions. Upon termination, your right to use the Service will cease immediately.

Limitation of Liability

Notwithstanding any damages that you might incur, the entire liability of the Company and any of its suppliers under any provision of this Terms shall be limited to the amount actually paid by you through the Service or 100 USD if you haven’t purchased anything through the Service.

Governing Law

The laws of the United States of America, excluding its conflicts of law rules, shall govern these Terms and your use of the Service. Your use of the Service may also be subject to other local, state, national, or international laws.

Disputes Resolution

If you have any concern or dispute about the Service, you agree to first try to resolve the dispute informally by contacting the Company.

For European Union (EU) Users

If you are a European Union consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident in.

United States Federal Government End Use Provisions

If you are a U.S. federal government end user, our Service is a “Commercial Item” as that term is defined at 48 C.F.R. §2.101.

United States Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to the United States government embargo, or that has been designated by the United States government as a “terrorist supporting” country, and (ii) you are not listed on any United States government list of prohibited or restricted parties.
